Article 140 of the Constitution provides:... "The Constitution guarantees the autonomy of municipalities They enjoy full legal personality Their government and administration it is up to their respective councils, composed of mayors and councilors Councillors are elected by the residents of the municipality by universal, equal, free, direct and secret, in the manner established by law. Mayors are elected by councilors or by neighbors. law shall regulate the conditions under which appropriate regime open council " .

That is, the Constitution contemplates that the mayors are elected directly by the residents.

Moreover, in 1978 the government of Adolfo Suarez introduced a bill providing for the Local Elections automatic designation as mayor of the head of the list of most voted candidate.

This initiative of the Socialist Parliamentary Group proposed substantial changes affecting the direct election of the mayor and the establishment of an electoral premium for mayor political group winner or a runoff.

However, when the House of Representatives was dissolved this legislative initiative expired.

Later in the electoral program with the PSOE attended the 2004 General Election, the party restated direct election.
