Article 140 of the Constitution provides:... That is, the Constitution contemplates that the mayors are elected directly by the residents.
Moreover, in 1978 the government of Adolfo Suarez introduced a bill providing for the Local Elections automatic designation as mayor of the head of the list of most voted candidate.

However, when the House of Representatives was dissolved this legislative initiative expired.
Later in the electoral program with the PSOE attended the 2004 General Election, the party restated direct election.
