The Council of Ministers held last week approved the draft Law amending the Criminal Code, including provisions designed to combat serious scourge of thefts and robberies committed in rural areas, according to the PP councilor, Diego Muñoz.
Totana Popular Party welcomes the reform, as it represents an important advance in the criminal justice response to the crime wave that plagues the country and welcomes the announcement by the Government to intensify surveillance in rural areas with the plan announced by the Interior Ministry.
Much of the proposals submitted by the agricultural organizations the Minister of Justice, Alberto Ruiz Gallardón last April are now contained in the bill that will amend the existing Criminal Code.
It is the first time that specific references are included in the agricultural sector in the criminal standard.
In addition to the aggravation of the penalties for members of organized groups or gangs and to the authors of forest fires, we must mention the introduction of four specific cases, fully apply to agriculture and constitute a type of theft crime aggravated to be punished with imprisonment for 1-3 years
a) the theft of agricultural products or livestock or the means used to obtain it, if the offense is committed in agriculture or livestock and serious harm to, without requiring a minimum value of the amount of the stolen, but what matters is the serious damage it causes.
b) also, is a crime of grand larceny when particular seriousness, by the value of the stolen or damage caused; circumstances unfortunately been occurring frequently in rural areas and it is expected that now be taken into consideration by the judges.
c) for professional criminals, they also act in this area, will be punished with the death penalty aggravated, when acting with the intention to provide themselves with an income not merely casual, making it a factor of recidivism.
d) it introduces a new article that punishes the theft of pipes, wiring, equipment or infrastructure components power or telecommunications services, event that happens very often in farms and ranches.
Moreover, he joined the Criminal Code art.
235 bis, which aims to respond to organized crime, punishable by 1-4 years in prison, when one of the participants in the crime carrying a weapon or dangerous instrument or in the case of a member of a criminal organization that is dedicated to continuously committing property crimes (of course also quite common in the area where the thefts and robberies are committed by organized groups or gangs).
