The Provincial Court of Murcia has informed the City of Totana that it agrees to dismiss the appeal filed by the Association Libertas sui Iuris, thus confirming the order of dismissal and filing of the case collected in the car of the Court of Totana for the repainting of the Pedestrian crossings with the rainbow flag.
In this way, the order is firm, with which this procedure of the Chamber is terminated after several months, since the Court of Instruction number 2 of Totana issued on January 11, 2019 the provisional dismissal and filing of the performances.
The Court of Instruction number 2 of Totana had issued the order with the provisional dismissal of the proceedings for the criminal complaint filed by the Association Libertas sui Iuris against the then mayor, Andrés García, and the Councilor for Equality and Defense of Collective Rights LGTB, Eulalia Moreno, for an alleged crime of prevarication for the repainting of two crosswalks with the color of the rainbow flag in the Constitution Square of this town.
This initiative was carried out in June 2018 within the sensitization activities organized by the City Council on the occasion of the Week for Respect and Equality of the LGTBI Collective in Totana.
The judicial order already indicated that "the concurrence of any crime of prevarication had not been sufficiently justified, when the absence of the subjective element configuring it was detached from them."
The criminal complaint by this association was admitted for processing in September 2018 for a crime of prevarication, although the complainant filed against the aforementioned municipal responsible crimes of prevarication, against road safety and embezzlement.
The mayor of Totana, Juan José Cánovas, has shown his satisfaction for the car of the Provincial Court of Murcia because, with him, against which there is no recourse, it is shown that "it was an ideological and political complaint", as he said , "it was a mere symbolic fact of citizen awareness in favor of this social collective".
This complaint was supported by the Spanish Falange, who boycotted the initiative with the placement of banners on the bridge of the Rambla de La Santa and painted on the same crosswalks.
Cánovas has indicated that "we are in luck because, from the initial order, it was already clear that it was an action without bad will, and that it had a provisional character during the days that this awareness campaign was held in the municipality."
He reiterated that the complaint was only intended to wear down the mayor, the Councilor for Equality and the then government team of the PSOE-Win IU.
In addition, the mayor has congratulated this car in a time of setbacks of freedoms, Justice put in its place individual and social rights of people.
This initiative was framed within the awareness and awareness actions of the Week for Respect and Equality of the LGTBI Collective that was held in Totana from June 18 to 29 with numerous awareness and cultural activities.
This was one of the most visible actions of the campaign that the City Council promoted from the Department of Equality and Defense of the Rights of the LGTBI Collective to "promote equal rights, freedoms and social recognition of LGTBI people and eradicate any discrimination ".
The Week for the Respect and Equality of the LGTBI Collective took place, for the third consecutive year, with the organization of numerous awareness and cultural activities, promoted by the Department of Equality and Defense of the Rights of the LGTBI Collective, the Municipal Council for Equality and several social groups in the Region of Murcia.
